Clients are encouraged to use our services as a strategic resource, not a substitute for legal counsel or professional judgment.

3. Risk Assessment and Client Authority

The information-backed assessments and supporting materials provided by Fortify Partners are intended to assist clients in making more informed business decisions. However, all final decisions to engage, approve, deny, or otherwise transact with a broker, tenant, or third party shall be made at the sole discretion and risk of the client. Fortify Partners does not assume responsibility for the outcomes of such decisions.

4. Use of Third-Party Services

The Site and certain services may incorporate data or integrations from third-party platforms, including but not limited to FMCSA databases, compliance tools, and financial processors. Fortify Partners shall not be liable for service interruptions, inaccuracies, or data breaches arising from or attributable to third-party systems.

5. Payment and Subscription Terms

All services, including recurring subscription offerings, are subject to the pricing and billing terms disclosed at the time of purchase. Subscriptions will automatically renew unless canceled prior to the renewal date. Partial-month cancellations and unused services are non-refundable, unless expressly stated otherwise in writing by Fortify Partners.

6. Limitation of Liability

To the maximum extent permitted by law, Fortify Partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or services, including but not limited to lost revenue, lost data, compliance disputes, or third-party claims. All services are provided 'as-is' without any warranty of performance or result.

7. Indemnification

You agree to indemnify and hold harmless Fortify Partners, including its officers, directors, employees, and affiliates, from and against any third-party claims, demands, liabilities, or expenses (including reasonable attorneys’ fees) arising from your use of our services, reliance on the information provided, or violation of these Terms. This clause is intended to promote fair use of the Site and preserve the integrity of the services we offer.

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in Arizona.
